Supreme Court (SC) Stays Lokpal's Order Granting Jurisdiction Over High Court Judges
The Supreme Court has temporarily stayed an order by the Lokpal that granted it jurisdiction over High Court judges, asserting that all judges, including those in the High Court and Supreme Court, are appointed under the Constitution and thus enjoy immunity from the Lokpal's jurisdiction.
Lokpal’s Observations:
In a recent order, the Lokpal had categorized High Court judges as "public servants" under the Lokpal and Lokayuktas Act, 2013, bringing them under its jurisdiction. However, Lokpal had previously ruled that the Chief Justice of India (CJI) and Supreme Court judges are not subject to its jurisdiction, as the Supreme Court was not established by a parliamentary act.
Reasoning for the Difference:
The Lokpal's stance was based on the fact that High Courts were established through British-era laws, such as the Indian High Courts Act, 1861, and predate the Indian Constitution. In contrast, the Supreme Court was created under Article 124 of the Constitution.
Lokpal Jurisdiction Under Section 14 of the Lokpal Act, 2013:
- Former/Present Prime Minister: Excludes matters related to international relations, security, public order, atomic energy, and space. Inquiry initiation requires approval from a full bench of the Lokpal (Chairperson + all members) with at least two-thirds of its members in agreement.
- Former/Present Union Minister or Member of Parliament: Includes government officials from Group 'A', 'B', 'C', or 'D' serving in connection with the affairs of the Government of India, as well as chairpersons, members, officers, or employees of bodies or organizations established by Parliament or funded or controlled by the central government.
- Foreign Contributions: Bodies that receive foreign donations exceeding ₹10 lakh per year under the Foreign Contribution (Regulation) Act, 2010, also fall under the Lokpal's jurisdiction
